Lemko Corporation, a leading provider of wireless broadband services, has recently filed a lawsuit in the Eastern District of Texas, accusing AT&T and its subsidiaries of infringing upon seven of its patents related to network communications. The case targets AT&T’s Private Edge 5G Network platform and Private Mobile Connection service. This legal battle is just one part of Lemko's broader strategy to protect its technology, which it claims is vital for the future of 4G/5G wireless networks.

Lemko, founded in 2002 by President Shaowei Pan, is renowned for its edge-capable mobile network platform and its innovations in multi-access edge computing (MEC) technology. The company has been at the forefront of providing solutions for the Industrial Internet of Things (IoT), private 4G/5G networks, and public safety and military applications. One of its notable achievements was the launch of wireless broadband services in Cairo, Illinois, where it has been providing connectivity to rural residents since 2016. Pan’s patents cover various innovations in improving communication networks, with the seven patents now at the center of the lawsuit, including patent numbers 7,840,230; 7,979,066; 8,224,322; 8,310,990; 8,340,667; 8,359,029; and 9,198,020. These patents, Lemko argues, are crucial for enhancing MEC networks and improving the infrastructure that supports them.

Interestingly, the patents Lemko is asserting against AT&T differ from the ones it previously brought against Microsoft. In 2022, Lemko filed a lawsuit against Microsoft’s subsidiary, Affirmed Networks, in the Northern District of Texas. The case has since faced numerous procedural delays, with Affirmed Networks filing multiple motions to dismiss the claims. Despite these setbacks, Lemko remains committed to its fight, having amended its complaints twice as the case moves through the courts.

Lemko’s legal representation is provided by the law firms Hilgers Graben PLLC and Kramer Levin Naftalis & Frankel LLP. The lawsuit against AT&T is currently assigned to District Judge Rodney Gilstrap, a seasoned judge known for his expertise in patent litigation. As the case unfolds, Lemko’s determination to defend its intellectual property rights and assert its position as a leader in the wireless communication sector will be closely watched.
